FirePing – Terms of Service and Privacy Policy

PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT" OR "TERMS OF SERVICE") CAREFULLY BEFORE USING THE SERVICES OFFERED BY FIREPING ("FIREPING," "WE," OR "OUR"). THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE FIREPING WEBSITE, APPLICATIONS, AND ALL RELATED SERVICES, INCLUDING, WITHOUT LIMITATION, WILDFIRE DETECTION, EARLY WARNING SYSTEMS, AUTOMATED FIRE PROTECTION TRIGGERS, API INTEGRATIONS, WEBHOOKS, AND MCP INTEGRATIONS (COLLECTIVELY, "SERVICE(S)"). BY USING THE SERVICES IN ANY MANNER, YOU AGREE TO BE BOUND BY THIS AGREEMENT.

Acceptance of Terms of Service

The Service is offered subject to acceptance without modification of all the terms herein and all other operating rules, policies, and procedures that may be published by FirePing from time to time. Some features may be subject to additional terms and conditions, which are incorporated by reference.

FirePing may refuse to offer the Service to any person or entity and may change its eligibility criteria at any time.

Rules and Conduct

• FirePing provides wildfire detection and automated fire protection system triggers based on NASA satellite and other data sources. Accuracy, timeliness, and completeness are not guaranteed.
• FirePing is not an emergency service and does not replace professional fire safety equipment or systems. Always follow instructions from official emergency authorities and first responders.
• You are responsible for properly configuring and maintaining your automated fire protection systems. FirePing triggers are informational and should complement, not replace, local fire detection systems.
• You will not use the Service to create false alerts, spread misinformation, or interfere with the safety of others.
• You will not exploit, abuse, or overload FirePing systems (e.g., excessive automated queries, scraping, or misuse of APIs).

You agree not to use the Service in any unlawful, harmful, or fraudulent manner, or in violation of applicable local, national, or international laws.

Data Sources and Disclaimer

FirePing relies on third-party sources such as NASA FIRMS satellite data and other providers. FirePing does not control these data sources and cannot guarantee their availability, accuracy, or timeliness.

You acknowledge that FirePing does not replace official fire warnings, evacuation orders, emergency communications, or professional fire safety systems. FirePing provides early warning detection to complement existing fire protection infrastructure. Use of the Service and any automated system triggers is entirely at your own risk.

Fees and Payments

• FirePing offers free and paid subscription plans.
• Paid plans renew automatically unless canceled prior to renewal.
• Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
• Refunds: purchases are eligible for a full refund within 14 days of the order date; see Refund Policy below for details.
• FirePing reserves the right to adjust pricing and plan features with notice.

Refund Policy

We want you to be confident in FirePing. If you're not satisfied, you can cancel and request a full refund within 14 days of purchase or renewal, no questions asked.

• Eligibility: Applies to subscription purchases and renewals processed by Paddle. The 14-day period starts on the order completion date shown on your Paddle receipt.
• How to request: Use the "Manage Subscription" link in your Paddle receipt, visit Paddle.net (Paddle Buyer Support), or email support@fireping.net with your order number and the email used at checkout.
• Processing: Refunds are issued by Paddle to your original payment method. Depending on your bank, funds typically appear within 3–10 business days.
• After 14 days: We generally do not offer refunds except for duplicate charges, accidental duplicate orders, billing errors, or suspected fraud.
• Cancellation: You can cancel at any time. When you cancel after 14 days, you keep access until the end of your current billing period and will not be charged for future periods.

Termination

FirePing may suspend or terminate your account if you violate these Terms. Either party may terminate at any time by ceasing use of the Service. Refunds are handled as described in the Refund Policy.

Indemnification

You agree to indemnify and hold harmless FirePing, its affiliates, employees, and contractors from any claims, liabilities, or damages arising from your use of the Service or violation of these Terms.

Limitation of Liability

IN NO EVENT SHALL FIREPING, ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR DATA, ARISING FROM USE OF THE SERVICE.

FIREPING’S MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID IN THE PAST 12 MONTHS OR (II) $100.

Privacy Policy

Information We Collect

• Account details: email.
• Subscription/payment details (handled by secure third-party processors).
• Geolocation and location preferences you set for fire alerts.
• Usage data: IP address, device info, access times, and interactions with the Service.

How We Use It

• To provide and improve fire alert services.
• To send you notifications, updates, and safety-related messages.
• To manage subscriptions and payments.
• To comply with applicable laws.

Sharing

• With service providers (e.g., payment processors, cloud providers).
• To comply with legal obligations.
• To prevent harm or fraud.

We retain personal data as long as necessary to provide the Service and comply with legal obligations.
